What the TCPA provides
The Telephone Consumer Protection Act (47 U.S.C. § 227) restricts calls and texts made with autodialers or prerecorded voices to your cell phone without your consent. The statute provides:
- $500 per violation — each illegal call or text counts separately
- Up to $1,500 per violation if the caller acted willfully or knowingly
- Protection for numbers on the National Do Not Call Registry

Signs a call may violate the TCPA
- A pause or click before a person comes on the line
- A prerecorded or artificial voice
- Texts that keep coming after you reply STOP
- Calls to a number listed on the Do Not Call Registry for more than 31 days
What to do right now
- Do not delete the texts or call log. Your phone records are the core evidence.
- Note the number, date, and time of each call.
- If you told them to stop, write down when and how.
